Below you will find a summary of all medical info. The mistakes, which there
was many, and the experts' opinions.
December 18th
Alexa' was seen for blood in her stool 2 nights ago. Mother switched her
formula from Similac to Isomil. Mother asks about bruising. (the mother claimed
she was told Alexa' just had varicose veins and not to worry as long as they
went away.)
December 19th
Alexa' was seen for a follow up where the doctor noted she did well overnight.
(Nick took her to this appointment he was told she had a virus.)
December 21st
In Alexa's records there is a report stating that Alexa' had fine pustular
melanosis, (others specified congenital anomalies of skin) See info on main
web page for definitions of this notation.
January 21st 12am
The mother takes Alexa' to the doctor. She made it clear to Nick that it
was because she wouldn't keep her feedings down. She never mentioned concern
about the earlier incident where Alexa' may have been jumped on. When she
arrives at the hospital she the chief complaint is notated as follows: “Mother
states, “she was sitting on couch and father 2 days ago and sibling fell
on top of her.” Not sure if anything is wrong.”
Doctor notated that the mother said 3 days ago child may have been jumped
on. He notes that Alexa' is completely content when held. He takes X-rays
and discharges Alexa' at 0418. A healthy and spoiled baby. (the mother said
he rolled his eyes after saying Alexa' was spoiled from being held.)
Alexa' was discharged with several old rib fractures not caught on the X-ray
at the military hospital. These rib fractures were not caught by this hospital
until after Alexa' stops breathing at home 54 minutes after leaving the ER.
January 21st 0514
911 is called because Alexa stops breathing. The ambulance takes her to Gateway
hospital. Here they find the overlooked broken ribs. No notation about new
fractures was made.

“There may be a mild cardiac enlargement. There may be an infiltration, particular
in the right base.”
“Severely limited examination with the possible right lower lobe infiltration.”
At 0604 the hospital notes they are still, “bagging baby placed on baby warmer.”
At 0714 Alexa' was Life Flighted to Vanderbilt Hospital
Mistakes Made
Vanderbilt misses the skull fracture
Reports retinal hemorrhages (autopsy findings say she did not have retinal
hemorrhages.) Shaking an infant or small child may cause other injuries,
such as damage to the neck, spine, and eyes. Eye damage is very common and
may result in loss of vision (retinal hemorrhage). Reference:

Does not research the intraosseous line in Alexa's right tibia. (Could have
been a sign of brittle bones.)
One report on the skeletal survey reports the fracture in Alexa's left tibia
and the other reports it in the right, both reports were completed by different
parties.

Severe Shaken baby was diagnosed. ( Dr's are trained to diagnose Shaken Baby
when there is no other explanation for the child's brain injury. But they
miss the skull fracture. Dr Hain still takes the stand with his “HE” testimony
saying Nick had to have shaken Alexa' and demonstrated hitting her head against
a surface. But in fact they did not know about the skull fracture until after
the autopsy and Alexa' did not have retinal hemorrhages, if Alexa' had in
fact been shook the way Dr Hain explained there would have been retinal hemorrhages.
This is according to the Dr's and research.)
“No definite skull fracture is seen.”
“There is no bruising over the extremities noted. There is a small bluish
bruise over her left eyebrow.”
“There are no obvious scalp marks or contusions. There are no skull fractures.”
Dr Paul Hain
“Given the age of the fractures of the ribs and tibia, and the head injury
that must have occurred in the last 24 hours this child has been a victim
of abuse both in the last day and some point in the past.” (The time frame
left equal opportunity for either parent to have hurt Alexa' with no physical
evidence. This statement did not fit the prosecutions theory that Nick snapped
in the 20 minutes he had his daughter in his care. The Dr claimed there was
more then one occasion of abuse.)
(Dr Paul Hain testified against Nick and tried to narrow the time frame,
by saying, “She would have been immediately symptomatic,” but when asked
to state a specific time frame results to saying, “I have no Crystal Ball.”)
The Autopsy
Multiple Blunt Force Injuries
A. Patterned contusion on the forehead and right arm
B. Bilateral subgaleal hemorrhages
C. Linear Fracture of the occipital bone with dilated suture lines of the
skull
D. Subdural and subarachnoid hemorrhage, bilateral
E. Severe cerebral edema with dilated ventricles.
F. Acute hemorrhage around the right and left optical nerves.
G. Recent and Old rib fractures (The recent fractures were not found by Vanderbilt
and could have been from the heart donation.)
Organ donation—heart surgically removed.
Definitions
Contusion: a bruise or an injury of a part without the break in the skin.
Occipital Bone: The bone forming the rear (and rear bottom) of the skull.
Hemorrhage: The escape of blood through the vessels, bleeding.
Edema: Swelling
“There is no evidence of retinal hemorrhage.” (Against the findings of Vanderbilt)
“The cross sections of both eyes reveal normal eye structures without evidence
of retinal hemorrhage.”
“There is a slightly enlarged soft, movable lymph node in the neck.” (The
Medical Examiner did not remove the enlarged lymph node and test it. It could
have had answers to whether or not Alexa' had some kind of disease or reaction
to a vaccine.)
**Dr Gerber sat in on the the heart donation and autopsy.**
