We promote nonviolence in finding justice for
Alexa'. We want the case reopened and handled in a courtroom.
It is not our intention to slander anyone surrounding the case. We are
telling Nick's side of the story and have
also presented very important case information. We ask that all parties
form their own opinions when reading
the information at our web site.
Our View
Both parents should have been brought to trial,
side by side. There was not enough evidence to rule out one of
the other. There was even less of a reason to bargain with either
parents.
Questions Left Unanswered & Part of an Equation Completely
Unsolved
Parts of the equation are missing. Alexa'
suffered a terrible and painful death. We have Nick's role, determined
in a trial by a jury of his peers. The jury said Nick failed to protect
his daughter and that this conduct led to her death. Who was Nick
supposed to protect Alexa' from? Who murdered Alexa'?
Invitation
We invite all parties involved in this case to
tell their side of the story and we will post it at our site.
The public is not aware of the information
behind the case of a father brought to trial accused of murdering his
60 day old baby.
Below is the outline of the events surrounding the entire case, told
from Nick and his family's point of view.
Please take the time to read our information. Nick's story will shock
you. His daughter's murder “technically” remains unsolved. It has
appeared to us that there is no such thing as “INNOCENT UNTIL PROVEN
GUILTY”.
Our Objective
We are fighting to have Alexa' Nicole
Davidson's murder
case reopened, and all persons surrounding her death adequately
investigated.

February 14, 2001
Nicole and Nick meet at a laundry mat where they are both washing
clothes.
February 14, 2001 through May 18, 2001
Nicole and Nick begin a romantic relationship.
Approximately one month after they meet Nick goes away for a month to
train for Kosovo.
When Nick returns he discovers not only is Nicole married she is still
living with her husband.
Nicole comes to Nick's barracks room to give him the news that she is
pregnant.
***She says, I am pregnant I have had abortions
before so it's no big deal or we can keep it. It doesn't matter to me
either way.***
Nick tells Nicole he wants to keep the baby.
Nicole gets her own apartment she tells the manager of the apartment
complex she needed the apartment in order to get her older daughter
back. (This appears in the detective's follow up
report, information source was a neighbor.)
Nick leaves for Kosovo.
May 18, 2001 through November 21, 2001
Nick leaves with the understanding that Nicole and himself will remain
a couple, and raise their child together.
Nicole lives with a man named Wayne Helmick, she claims she only lived
there to watch his kids. (She was within
commuting distance and had her own residence.)
Nicole, “Slaps the s**t” out of Art Hamber's face. (He is her husband.)
There was a Military Police Report filed on May 30, 2001.
Nick can hardly get a hold of Nicole while overseas.
Art Hamber's claims that Nicole and himself reconciled in 05/01. When
she was living with a guy named David. She had an apartment with him. (This appears in Art's interview with DCS.)
Nicole and Nick communicate through letters while he is overseas. (Nick's letters to Nicole were never retrieved by
police officials during the search of the home, the camera zooms in on
one and they never take it.)
Summary of Nicole's letters
(Taken from her actual letters word for word. The spelling errors are
hers.)
>Nicole's mom is threatening to take Nicole to court to take away
her other daughter. “What am I going to do when she finds out I'm
having another kid. I just don't know what to do. I can't deal with all
of this. What an I going to do. I fell like all I do is sit around and
cry cuz I don't know how to make this all go away (w/whit and this
money problem) What king of life is that for ______ When is this all
going to go away?”
>”I am really worried about doing this whole baby thing again.”
>Nicole's mom came to visit. “It was the worst visit ever all she
did was yell @ me She makes me feel like I can't care for _______
There's a lot more to it but I won't go there. I really can't handle
this! My stomic is getting so big. I can't fit in my pants anymore. You
are not going to want to be with me anymore.”
>”I just got back from Jody's house You won't believe the things
my mom about me how I shouldn't have ______ (her other daughter) etc.”
>”I've really been thinking I think you can do better than me. I
think you should really think look @ the mess Im in look @ all the shit
w/______ dad. Do you really want to deal w/him for 18 years. And now I
cant evon support _______. I wont be able to go to school to better my
life
for a long time and my family is all messed up! I cant go out to do
things
because i have a child I cant just get up and go like a normal 21 year
old.
You really need to stop and think you so young you can get a woman with
no past you should be able to go out w/stopping to wipe a face look at
all
Im going through w/_____ father. Do you want to deal w/all of that. You
should
be able to have a family w/out someones mistakes following you around
you
cant evon tell people you work w/about your own child. I think you
should
just walk away and find someone who didnt make so many mistakes in
there
life! All Im going to do is bring you trouble and stress. I cant pay
this
month and I think that makes me two months behind. I wish you were here
then
I could work nights I dont know what I am going to do I cant make my
bills and now Im going to have another baby. I am so scared. When I
worked full time back home I had no problems but now I only work a
couple of days a week and Im so scared thats all I think about I really
dont know what to do. I just want you to be happy and not have worried
in your life. Im really not the one for you, you can do better for
yourself.”

to be older and more independent. No more diapers She can talk to me
& now its starting all over again sleepless nights and everything!
Im just glad you will be here with me. I cant afford two kids in day
care evon if I wanted to work I would have to stay home in November. Im
so stressed out about this.
Nicole only attends 3 prenatal visits starting in her fifth month. (This information was obtained on Alexa's application
for a birth certificate.)
Nick returns the same day his daughter is born.
Nick's family comes up from Knoxville to see Alexa'.
***Nicole went to the bathroom and remained there until the family
left.***
November 23, 2001
Alexa' is discharged from the hospital a healthy baby.
December 3, 2001
Alexa' is taken to the doctor by Nicole for her two week well baby
examine.
December 6-9, 2001
Nick and Nicole bring the girls, Alexa' and ________ , to visit Nick's
mother, Joy Thomas.
***Nicole stays in the back room the entire time.
She never helps Nick care for either of the girls.***
***She is heard making comments like, My daughter
never acted like that. This was toward Alexa' referring to her other
child as “My Daughter”.***
December 18, 2001
Nicole takes Alexa' to the doctor for blood in her stool. She asks
about “bruising” she has seen on Alexa'. The doctor told her they were
just varicose veins and as long as they went away not to worry. They do
a culture of Alexa's stool.
December 19, 2001
Nick returns with Alexa' to the doctor for her follow up. The doctor
told him she had a small stomach virus.
December 21, 2001
According to Alexa's records her culture comes back her records read;
fine pustular melanosis. They note specified congenital anomalies of
the skin.(abnormalities of the skin existing
since birth)
Medical Definitions
PUSTULAR: puss filed pimples or sores in clusters
MELANOSIS: relating to the pigment of the skin
CONGENITAL: existing from the time of birth
ANOMALIES: abnormal
These abnormalities existing since birth is what Nicole calls
“bruising”.
Somewhere between December 21, 2001 to maybe the beginning of
January 2002
Nicole and Nick visit Alexa's other grandparents in Maryland.
***After their return Nicole's mother calls
Nick's mother, Joy. She tells her she is lucky because Alexa' looks
just like her. She expresses concern that it seemed as if Alexa' was
having difficulty breathing and she asks Joy if she noticed it. Joy
said she wasn't sure. She
then comments about how she told Nicole that she better not let this
one
(Nick) go.***
Unable to classify by date
(Below is info provided by Nick, I have spent months pushing him to
remember as much as possible. He never thought these things were
relevant
to the case. As we try to investigate further, I do believe the
following
things make a difference. Please keep in mind Nick was arrested before
he
could fully understand what had happened to his daughter. Once he is on
trial
the following events could not be represented because he was the only
one
on trial. Once someone is arrested they no longer speak with the
prosecution. The prosecution could never sit in on an interview with
Nick because the detective
jumped the gun and arrested Nick immediately. With absolutely no solid
evidence.
It has been offered to the prosecution now, they claim Nick should have
a
lawyer first.)
***Wayne Helmick's kids call 3 and 4 times a day.
They are ten and/or younger. She is no longer babysitting for their
father. Shortly after the calls become out of control they start
hanging up when Nick answers.***
***Wayne Helmick was all Nicole talked about when Nick returned from
Kosovo.***
***Wayne Helmick enters Nick and Nicole's house without knocking.
Nicole notices Nick's frustration but says nothing.***
***Nicole insists that she needs extra hangers from Wayne's house when
they went to do laundry once. She didn't just go up to the door and get
the hangers. She went in and closed the door leaving Nick and the girls
waiting
in the car for twenty minutes.***
***While sitting on the couch with Nick and the baby Nicole comments
that she thinks Alexa' might be blind. Nick snapped his fingers and
when Alexa' blinks he says she not blind.***
***Nick noticed Nicole was not
actually strapping Alexa's car seat into the car with the seatbelt.***
***Their relationship became very distant. Nicole would go 3-4 days
without saying a word to Nick. She would sleep separately from Nick
during
these fazes of silence. Whenever Nick would approach her and ask her to
talk to him about it she would just cry.***
***Nick noticed Nicole never took out extra time to just play with
Alexa' she would do only the essentials such as; feeding her, bathing
her, and changing her diaper.***
***Whenever Nick couldn't get Alexa' to stop crying Nicole would grab
her from Nick and go upstairs to sleep. Once because she was so
frustrated when she went to get her from him she almost dropped Alexa'
then she became aggravated as if it was Nick's fault.***
January 18-21, 2002
January 18 or 19, 2002-Nick is in the kitchen and both girls are in
the living room. Alexa' is propped up on the futon with a pillow.

hears the beginning of Law&Order and runs and jumps on the couch.
Alexa'
began screaming. Nick rushed to get her and when he picked her up she
seemed
fine. Nicole was upstairs sleeping. (Taken from
the
combination of both parents explaining what had happened.)
When Nicole woke up he told her that he wasn't sure if ________ had
jumped on her or if she just scared her. (Taken
from
Nicole's February 20th interview)
Alexa' begins crying more then normal and it lasts for 3-4 days. She
has to be picked up or walked to console her. Nicole tells Nick that
she is just colicky.
On January 20, 2002
Nicole switches Alexa's formula to one for baby's with colic.
Alexa's crying becomes worse this day. She vomits twice. She only eats
nine ounces.
Alexa' is taken by her mother to Blanchfield Memorial Hospital at
twelve midnight. Chief Complaint reported to the triage nurse was
mother states “she was sitting on the couch with father 2 days ago
& sibling fell on top of her. Not sure if anything is wrong.”
Nicole reports symptoms began 2 days ago. She reported that she
switched her formula today. She reports Alexa's appetite was down. The
triage nurse observes that Alexa' is easy consoled by mother—cries when
laid down.
Nicole reports to the doctor 3 days ago Alexa' may have been jumped
on by other child.
The doctor orders chest X-rays. Alexa' is discharged a spoiled, healthy
baby @ 4:18am.
The last day January 21, 2002
Nicole arrives home and gives the baby to Nick to tend to her while
she takes a shower.
After Nick changes Alexa's diaper he picks her up and she begins to
gasp for air and completely stops breathing.
He rushes her up to Nicole and they call 911.
***Below begins the case info***
The 911 call is received at 5:14am
This is 54 minutes after Alexa's discharge. Officer Nalley is the first
to the scene from the front door of the residence he sees the ambulance
pull up. The ambulance arrives @ 5:23am.
Nicole begins her inconsistent stories with
the arriving officer.
Officer Nalley's Report Reads
Nalley witnesses Nicole doing normal chest compressions on Alexa', not
infant CPR.
The mother stated she was holding the child the entire time, that they
had just changed the child and it was crying the whole time. She also
stated that the child has been in the hospital and the doctor
instructed her to give the child a certain amount of a certain type of
medication when they arrived home.
Nalley asks the specific question, When did the child stop breathing
and how long had it been? The mother responded and stated, “that the
child had stopped breathing as soon as I gave her the medication and
that it was
around five minutes ago.”
***Alexa' is transported by ambulance to Gateway
Medical Center. Gateway transfers Alexa' via life flight to Vanderbilt.
Here the doctor's findings are that Alexa's injuries are consistent
with Shaken
Baby Syndrome, old & healing broken ribs, old fracture of left
tibia,
and a small bluish bruise over the left eyebrow.***
Nicole's statements to Carolyn Orr
She says she took Alexa' a little early for her 6 wk check up at Ft
Campbell because she was vomiting and she also noticed red marks on her
chest and arm which looked like finger marks. She said the doctor told
her
they were probably just varicose veins. She reports that more marks
appeared
5 days ago on her groin, arm, and mostly on her chest. Parents report
that
for the past three to four days Alexa' has been fussy and eating well-
they have to hold her all the time. Yesterday her cries became “blood
curdling” and she only 6 ozs all day. She reports they did tests and
X-rays and couldn't find anything wrong sent her home about 4am today
with “gas” medicine. She says she got father up when she got home to
hold Alexa so she could take a
shower. About 4:30 she said she heard a gagging kind of noise and then
father
told her something was wrong. Mother noted child was blue around the
mouth
and was not breathing. She called 911 and gave rescue breaths.
Nicole's statements to Sandra Smith with DCS
Nicole says she doesn't know how Alexa' suffered her injuries. She
stated she thinks it possibly could have occurred from when ________
accidentally fell on her sister the other day. She stated that the DR
felt her soft spot. She stated Alexa was throwing up, however Dwight
was holding her face forward and head down so that it would go straight
into the sink. She stated saw Alexa's head hit the faucet. She stated
that Alexa' did not sleep in the
baby bed the she mostly slept in a swing.
Ms. Bragg stated that Dwight had gotten frustrated because the baby
kept crying and he placed her on a Winnie the Pooh pillow, she stated
she
would not think that would fracture ribs. She stated she stays home
during
the day. She stated she ran away a couple pf times when she was 17
years
old. She says there was Domestic Violence in their relationship and she
was not going to put up with it. She stated that he pushed her. She
stated
he would not mind having sex in the same room as her older daughter.
***Now Nicole never repeats this same info she
tells a completely different story from this point on. Saying he was
never violent. That Nick was laid back. I don't know how many different
stories Nicole tells. It's so many you can't keep track of all the
changes.****
Nicole's statements to Dr. Taylor
Nicole tells Dr. Taylor that she was taking a shower while the father
was holding the baby. She states that when she finished the shower, the
father stated that the baby did not seem to be well, and Nicole noted
that
the baby was cyanotic and limp, and she preformed rescue breathing and
called EMS.
Nicole tells Dr. Taylor that she saw bruising on Alexa. She describes
these as “strawberry” appearing marks, “finger shaped”, “hand
print-type bruising”, not where “the diaper was fastened.”
Nicole says she asked Alexa's doctor about these bruises and the doctor
tells her they are just “varicose veins.”
Nicole's statements to Dr. Hain
Nicole states that Alexa' did not feed well, taking only 6 ozs over
the whole day. She claimed to arrive home at 4am.
Mom went upstairs to take a shower. Dad then came running up the stairs
and told mom something was wrong. Mom noted that Alexa's lips were
gray. Mom started rescue breathing and Dad called 911. Mom states that
she performed a few chest compressions, but mostly just breathed for
Alexa' and listened for her heart beat.
Mom has taken Alexa' to the doctor twice prior to this admission. 2
weeks ago, she took Alexa' to the Blue Clinic at Ft Campbell for “red
marks
on her that looked like fingers, kind of like a hand print,” The doctor
told her “they were varicose veins” and that they would culture the
stool
and to return the next day. They returned the next day and were told
that
the culture was negative and that the child was fine.
***The last record of a doctor visit was December
19, 2001. One month before this admission. In a report made by the
doctor dated December 21, 2001 the doctor reports that Alexa' has
abnormalities of the skin existing since birth.***
Nicole's Statements to The Detective
On Sun 20 Alexa' was crying like in pain she could not be put down she
wanted to be held. Alexa' eats every 2 hours 4 ozs @ a time on the 20th
she only ate 9 ozs all day. I took Alexa' to Ft Campbell @ 12:00 @
night the doc took blood and X-ray @ 4am the doc sent me home and told
me she was
just gassy and it was from holding her often. The lab test came back
fine.
I went home I gave her to her dad and got in the shower Dwight changed
her
diaper and cleaned her nose then I heard two gasps and Dwight ran her
up
to me. I gave her CPR until the EMS came.
States she is willing to take a polygraph examination to prove she
didn't cause any injury to Alexa'.
***Nicole never takes the polygraph test.***
She says Dwight was alone with Alexa' for 45 minutes while she took
a shower.
***45 minutes out of the 54 minutes from the time
Alexa' was discharged to the 911 call? ***
She says she told Dwight that it was easy to separate a baby's brain
stem because he picked the baby up quick.
***Alexa's injuries were not consistent with
being picked up quickly.***
She says once he picked Alexa up after changing above his head and
talked baby talk to her.
Alexa's injuries were not consistent to being held over Dwight's head.
She says he picked her up under her arms and around her chest but she
doesn't know if he held her head.
***Alexa's injuries were not consistent with
being picked up without supporting her head.***
She claims he was rough with Alexa' at times but not violently rough.
***Alexa's injuries were consistent with someone
violently shaking her and hitting her the back of her head against a
surface.***
She says he bounced her on his legs like she was in a bouncer not
violently.
***Alexa's injured were not consistent with
bouncing her on his legs.***
She says he did not seem angry with Alexa'. He was frustrated because
she was crying for a long time. She says they were both frustrated
because she was crying so long and could only be held and walked around.
**Nicole Bragg is never interrogated or treated
like a suspect.**
Nick's statements to Dr. Hain
Father states that the mother took child to Ft Campbell for poor
feeding. When she returned, she went upstairs to shower. Dad was
downstairs with Alexa'. Dad states that she made “a gurgling sound” and
he ran upstairs to
get mom. Mom started rescue breathing and dad called 911. Dad states
that
mom is the primary caretaker, and that nobody other than themselves is
alone
with the child. Dad states that mom is patient with the kids. He also
states
that her being married to somebody else has not interfered with their
relationship.
When asked directly about the old fractures, and the recent head
trauma, he states he doesn't know how Alexa could have gotten these
injuries. He does state that 3 days ago he was watching TV with Alexa
on the couch and was in the kitchen when he heard her screaming. He
came back into the room and Alexa's sister was on the couch. Dad states
he assumes that Alexa's sister had jumped on the couch and landed on
Alexa', but the baby looked ok.
***In Nicole's February 20, 2002 statement she
claims _______ told her she had jumped on Alexa'. That she had acted it
out. To this day Dwight will tell you he was not sure because he was
not in the room with her. He assumed or thought that maybe she was
jumped on.***
Nick's interview with Sandra Smith (The Detective was present.)
He claimed Nicole would tell him to be careful of the soft spot and
not to jerk the baby because her brain stem could detach easily.
He stated he didn't know how Alexa' would have broken ribs. He stated
that he had picked her up quickly several times because she was
screaming. He stated it was a cycle “sleeping to screaming”. He stated
no more than
five times did he “snatch her up quickly”. He stated that he does not
feel
he should take a polygraph test because he feels the Detective wants
him
to say he did it. He stated he had seen spotted bruises on her chest
and
the doctors at BACH said she was fine that it was just varicose veins.
Dwight tells DCS that 3 days ago ______ jumped on the couch out of
excitement because Law & Order was coming on and he thinks she may
have been injured then.
***“Snatched her up quickly”
was the
statement that led to Dwight's arrest. Alexa's injuries were not at all
consistent
with being “snatched up quickly”. After this statement DCS reports that
Dwight
Davidson is not admitting to any wrong doing at this point. DCS still
considers
that both parents could be responsible for Alexa's injuries. She does
not
seem to take Dwight's “snatching up” statement as an admission of
guilt.
The Detective takes this statement and begins interrogating Dwight. The
Detective
had used the “snatching up” statement several times that day before
Dwight
says it. Dwight did not realize he was being set up to incriminate
himself.***
Nick's statements to the Detective
Dwight says anytime Alexa' would cry I would quickly pick her up to
hold her which got her to stop crying. Through out the day and night. I
would pick her up no more then five times in a 24 hour period.
Nikki took Alexa' to the hospital around midnight that night and
returned between 4:30-5:30am. At that time she gave Alexa' to myself
while she took a shower. Then I changed her diaper, and she was crying,
so I picked her up quickly to try and comfort her and she began to
wheeze so I took her to Nikki and she said she wasn't breathing, and we
called 911. He says he told the Detective he had “snatched her up
quickly”. He admits to raising Alexa' above his head. He claims he has
laid Alexa' across his knees and held her head while bouncing her.
**In the Detective's Crime Report he claims that
after Dwight says I think I need a lawyer, He asks Dwight, “It hurts
doesn't it?” and Dwight said it did. The Detective claims to tell
Dwight that sometimes it helps if you talk about it. He states Dwight
then says, “I didn't know what I did would hurt her.”***
***The jury did not buy this so called confession
or Dwight would have been in jail for 60 years. Detectives are known to
twist statements to obtain an arrest, or completely make them up to
support
their “hunches”. ***This so called confession is not documented or
recorded.*** Which is strange because Dwight is willing to write down
the incriminating “snatching up statement”. Again they try to make it
look as if Dwight may have accidentally hurt Alexa'. This is before the
skull fracture is discovered. Alexa's injuries were not accidental.
They were a result of someone taking their anger, resentment, and
frustrations out on her. She was abused more then once.***
That evening at the hospital
(The following are events the family remembers.
It is their side of the story. They were NEVER interviewed in the case)
***Nick's mother and step-father, as well as Nicole's mother were
present that evening at the hospital with the parents. They encourage
the parents to eat and neither parent eats much.***
***Nicole asks Nick if he thinks it could have happened when she bumped
her head against the faucet. He says he doesn't think so.***
***Nicole's mom goes on and on saying, “If you just act like you have
money you won't get in trouble.” Which no one responds to.***
***Nicole and Nick's mother visit Alexa'. In the hallway after the
visit Nicole says, “There's nothing wrong with MY daughter I don't know
why there is something wrong with THIS daughter.”***
***The grandparents stay at nearby hotel.***
***Close to midnight Nicole demands Nick to take her home. He is
hesitant and asks Nicole why. She says she just wants to go home. So he
takes her home.***
***They sleep in separate beds. Nicole goes to the girls room, grabs
one of _______'s stuffed animals and sleeps in _______'s bed.***
***Nick sleeps in their bed.***
January 22, 2002 the next morning
***Nicole is up and ready to go when Nick wakes
up. He said it was as if she was leaving with out him. He asks her to
wait and takes a quick shower.***
***After they arrive back at the hospital Nick meets up with his mother
and the Detective was there. He asks Nick do you want to talk to you.
Nick asks if he can wait for his step father. The detective says no.
They take him in a room and ask him if he wants to talk there or at the
police station. Nick says he's not talking without a lawyer. So they
arrest him. His mother asks if he can stay until Alexa' is disconnected
from the ventilator and he says no. She asks if she can hug him and he
says no.***
Nicole flags the detective down and gives another statement
On the 20th of January, 2002 I was in the kitchen cooking. Dwight was
holding Alexa' facing away from him. Her head fell forward and hit the
faucet . I don't know if it was when her head fell forward or he was
picking
her up.
Vanderbilt's diagnosis of Alexa's injuries
- Severe Shaken Baby Syndrome
- Old Rib Fractures
- Old Tibia Fracture
- One bruise over her left eye brow
***Vanderbilt misses the skull fracture. It is
not discovered until the autopsy. With so many medical mistakes how
could they believe a father should have known something was seriously
wrong with his daughter. The doctor at Blanchfield was told about the
3-4 day crying spells and the possibility of the other child jumping on
her. 54 minutes before she stops breathing she is seen by a medical
doctor and he discharges her as a healthy, spoiled baby. Blanchfield
misses the old rib fractures. According to information obtained by
Nick's lawyer the recent rib fractures on the left side appeared on the
Blanchfield X-rays.***
***There was no evidence against either
parent. They had no reason to rule either parent out at this point,
both
parents should have been arrested!!!! All they had was hearsay from
both
parents.***
After Nick's arrest Nicole refuses to be with Alexa' when she is
disconnected form the ventilator and tells the nurse everything should
go through her mother. (this is reported in Alexa's records.)
Alexa's heart is donated.
***Nicole was completely against the heart donation before Nick was
arrested he tried desperately to convince her to do it. She decided to
approve only after he is already arrested.***
January 23, 2003 The funeral/wake
***Nicole refused to plan Alexa's funeral. When
Nick's mother asked Nicole's mother why, she explains Nicole doesn't
know what she wants she's need like that she she was little. The family
had
already retained a lawyer with every dime to their name, but they said
they would pull together to get it planned. They found a wonderful man
named Mr. Tarply agreed to do the entire funeral free of charge. Nick's
mother had to have Alexa's little body released from the medical
examiner's
office. She had nothing to wear and since Nicole would not participate
the family purchased an outfit for Alexa' to be dressed in. They were
concerned
about how she would look, but Mr. Tarply did a wonderful job preparing
her for their final good-byes.
As the family was getting ready for the funeral in their hotel rooms
and while some of the family was already on their way Nicole phones
Nick's mom and told her that no one could attend the funeral because
there were certain family members she didn't want there. She said there
would be police and she hung up.
The family hurried to the funeral home to see if there was something
that Mr. Tarply could do and he regretfully informed him he could not
help. He did snap a few pictures for the family and when Nicole
demanded that he even remove the flowers the family had sent he put his
foot down. He told
Nicole that the family went out of their way to help and she had
already banned them, the flowers were staying. Mr. Tarply then handed
the family a
bag and informed them that Nicole had demanded that they undress Alexa'
and
have her redressed in different clothing. The family never had a chance
to
say good-bye to Alexa'.***
***Nick's family goes to collect his belongings and there is a note
on the door that stated; Nicole call Wayne Helmick at, and there was a
phone number that was listed to Rachela Balick, it was signed by
Rachela
Balick.
Nicole calls Rachela, Michelle Balick in her February 20, 2002
interview and states she saw the bruising on Alexa' during a doctor's
visit. The only two doctor appointments Nicole takes Alexa' to alone
was December 3, 2001 and December 18, 2001.***
***I personally called Rachela and asked her when she saw these
“bruises” on Alexa'. She said a week before her death. When I told her
the last documented doctor's visit was December 19, 2001 and her father
took her. She said she couldn't say exactly the time. I asked her to
describe what she saw on
Alexa'. She said bruises. I said exactly like bruises and she said yes.
She claims there were many. I told her Nicole said they were like red
marks or a strawberry and that the only marks she could have seen was
one on her
leg. She said they looked like something that wasn't supposed to be
there
and she had nothing else that could help me.***
Nicole's recollection of the last 54 minutes before Alexa' stops
breathing.

Nicole walks from Blanchfield Memorial Hospital to her car, she
situates Alexa' in her car seat, drives the 20 or so drive home, takes
Alexa' from the car into the house, wakes Dwight twice, has
approximately a 5
minute conversation with Dwight regarding the visit to the emergency
room,
“she went upstairs to get into the tub and she walked back downstairs
to
give Alexa' more gas drops”, she watches to be sure Alexa' takes them
fine,
she goes back upstairs to get into the shower, she takes a 30 minute
shower,
she takes a 45 minute shower, she is in the shower when she hears
Alexa'
gurgling, she gets out of the shower and hears Dwight sucking the
congestion
out of Alexa's nose, she discusses with him whether there was a lot in
there,
Dwight tells her that he changed Alexa's diaper, she asks Dwight what
type
of bathroom she did and he tells her, and then she hears two “high
pitched
gasps” and Dwight comes running up the stairs with Alexa, She was still
wearing
a towel, no she had her shirt on, Dwight says I think there is
something
wrong with her, Nicole says no the doctor says she's fine I have to
take
her back at nine, and she has her back turned, Dwight comes up the
stairs
with Alexa', and when she turns around she sees Alexa's lips are
purple.
***All of this happens in just 54 minutes? In
this order? In this exact sequence according to her statements.***

ADA: Can you describe the noises? You said high pitch noises that she
made and I it looks like you said that it was thumps at one time or gas

Nicole: I never heard a thump. I heard her being sucked out and then I

Nicole: Oh her the not ugh the bulb thing that you suck their nose out
with....
ADA: Was it like a scream or like a gasp or like ugh
Nicole: No it was like a high pitch gasp sound. I've never heard it
before you know so
“The Thump”
Nicole testifies at the trial that she hears a thump as she steps from
the shower just prior to Dwight running upstairs.
January 25, 2002
The detective requests an interview with Nicole, her attorney says that
he would be willing to allow his client to talk to the detective if he
recorded the interview.
January 30, 2002
Nicole violates a no contact order set out by DCS for her other
daughter, ______. She appears at the Kingsbury residence during an
arranged visit with ______'s father. Her parents dismiss this claim
saying ______ never saw her mother and that her mother had thought the
visit was over. The grandmother said she flagged Nicole away from the
window.
POLICE REPORT #02-001583 (Incident
report was discovered after the trial.)
The police are called on Nicole by her husband Art Hambers. The
incident report reads, The victim was visiting his daughter at listed
address when his wife (suspect) approached his vehicle and yelled at
him. The victim stated that the scratch was not on his vehicle before
his visit. These allegations are reported by Art Hambers.
***This is only 7 days after Alexa's death. The
grandparents want us to believe that _____ did not hear her mother
yelling at her father. If Nicole had actually had an altercation with
Art she must have seen his car was still there. It appears that Nicole
was not the only one willing to lie in this case. At the trial Nicole
testifies that she
is not easily angered.***
January 31, 2002
The police have not heard from Nicole or her lawyer. The detective
phones Nicole's lawyer and tells him The Assistant District Attorney,
told him to tell Nicole that she was going to have to give him a reason
not to charge her. The Assistant District Attorney asks for an
interview that Monday or Tuesday afternoon.
***Nicole is obviously not cooperating well with police. WHY? How could
they give her an obtain of coming up with a reason not to be charged?***
February 04, 2002
The detective calls Nicole's attorney and leaves a message to call them
back and set up an interview with Nicole.
***Why is Nicole or her attorney avoiding the
interview. If Nicole truly believed that Nick murdered their daughter
wouldn't
she be ready and willing to help any way she could?***
***Why is she not arrested now? Why is she is
calling the shots in this case?***
***The search warrant is signed on this day but
they do not execute it until two days later. WHY?***
February 05, 2002
On this day the detective contacts DCS asks if _______ has been talked
to. DCS tells him _____ told her foster parents that “Baby cried and
cried and cried, daddy shook baby and now baby is sick.”
****This is probably one of this sickest things
in this case. This is not a child's explanation and why now, 15 days
after Alexa's death does ______ suddenly say this and not when it
should have been fresh in her mind. Nicole claims _______ was sleeping
when Alexa' stops breathing. The grandparents had visits with _______
and the mother violated her no contact order. Someone had to have told
______ this. This was an adult
explanation. Who is “daddy” anyway? Nicole had _______ around several
men.****
DCS tells the detective that Nicole's mother said Nicole heard “two”
thumps while she was in the bathroom just prior to Nick running up the
stairs
to her with Alexa'.
***Strange that this is the first time the thump
is mentioned and by Nicole's mother. In her February 20th interview (15
days later) ,after her mother makes this statement, Nicole specifically
says
she did not hear a thump when asked by The Assistant District
Attorney.****
DCS says _____ is now in Maryland with her grandparents. Nicole told
her she was leaving to Maryland and they asked where in Maryland,
Nicole told them it was none of their business.
****These are the people that will decide whether
or not Nicole will ever get _____ back. Why is she not cooperating with
them? The grandparents having ______ was just a temporary plan wouldn't
she cooperate?*****
February 6, 2002--The search of the Kingsbury residence
Police do not search the residence until over 2 weeks after Alexa's
death. Nicole had complete access to the home during this time. They
take
notes Nicole wrote about Alexa's final days. They do not collect at
least
one letter Dwight wrote to Nicole while he was in Kosovo. The camera
actually zooms in on this letter and stays there for several minutes.
This letter may
have contained information about his feelings toward his unborn child.
They
do not take the nose syringe that Dwight used to suction Alexa's nose
just
before she stopped breathing. This could have been a key piece of
forensic evidence since cerebral fluid can leak from a child's nose
after a head injury. They do not look into a phone number written on
Nicole's bedroom mirror to find out if there could be another man
involved.
They search the residence over 2 weeks after Alexa' stops breathing.
Nicole had full access to the home all this time. Nick's family
witnessed her moving our belonging on January 23, 2002 when they
arrived to retrieve Nick's personal items. What did they think they
were going to find over two weeks later?
***Nicole's attorney calls the detective February
12, 2002. He asks him if he served a search warrant on Nicole's
apartment. He tells him he had. He stated that she was very upset. Why
would she be upset wouldn't she want to cooperate?***
February 07, 2002
Dr. Hain speaks to the detective and says his opinion on the onset of
the symptoms. He said the symptoms would have been within 24 hours. He
said with rib fractures you do not see calcium build up for at least 7
days. He stated that their were two distinct times of injuries to
Alexa'.
He stated it would be better to get an opinion of a Neurologist.
***This leaves equal opportunity for either
parent to hurt Alexa' at two separate times. Why wasn't Nicole
arrested? She is avoiding the interview and is not cooperating.***
***The case never shows anyone obtaining the opinion of a
Neurologist.***
February 12, 2002
Nicole's attorney contacts the detective says Nicole is upset over the
search of her residence. The detective stated that he had tried to get
a hold of her for two days. He stated that he would let me know if his
client was able to sit for an interview or not on Friday the 15th.
***Again Nicole seems to be running the
investigation. She is still avoiding the interview and police are
patient with this. Since when do police warn someone about the search
of their home in a murder case. Why would they try to get a hold of
Nicole before searching the residence?***
February 14, 2002
Nicole told a neighbor Nick wanted nothing to do with Alexa' or her
when he returned from Kosovo.
***Nicole paints a completely different picture
in her February 20th interview. It seems she tells certain people one
thing and others another. She can't seem to keep her stories
straight.***
The Assistant District Attorney says that they should think about a
paternity test to see if Davidson is the real father.
They make this comment but never explore the possibility of another
man.
February 15, 2002
Nicole's attorney calls the detective and says he hasn't been able to
get a hold of his client.
***Still, Nicole is not arrested.***
Later that day her attorney calls back and says he
was able
to get in contact with his client but hasn't had a chance to sit down
and
talk to her yet. He wants to reschedule the meeting for the 20th.
The phone records (They subpoenaed
the phone records February 15th)
There was a phone call made from the Kingsbury residence through
1800Collect while both parents were at the hospital, 0754 in the
morning. Who made this phone call? The police never investigated this
mysterious phone call.
***The parents had calling cards. Certainly this
could have been billed to the home number, but it is up to
investigators to rule things out. This really goes back to the
Assistant DA saying maybe they should do a paternity test. Could some
other man have had access to the house?***
February 20th, 2002 The Interview in Exchange for Immunity
***With the offer of immunity against truthful
statements, offered to her by the prosecution after her stories are
already inconsistent, Nicole agrees to an interview. This immunity does
state that they have not made a decision as to whether there will be
charges brought against Nicole.***
***This interview is 31 pages long. In the interview Nicole gives no
testimony of the events surrounding Alexa's death that can be grounded
in
fact.***
***She actually paints the picture of Dwight as a wonderful father.***
ADA: You know I guess we're trying did you ever see anything about the
way ugh your husband, was it Nick, is that his name? I'm sorry. Did you
ever see anything about the way he treat her that caused you any
Nicole: No
ADA: Fears or concerns or questions
Nicole: No he was the total, I mean my older daughter her dad has never
ever been their for him or for ______ so it was the total opposite you
know and ugh he actually took care of her more than I did. I mean he
would
tell me why don't you wake me up at night. He always wanted to take
care
of her the first night she was born you know. I mean there was nothing
that I would have thought hey look out for this person or I never would
have let him around either.
ADA: Did he have a hot temper that you know of? I mean did you ever
see him get violently angry or just
Nicole: No and we've gotten into arguments ugh but he never loses his
temper or anything like that.
ADA: Okay is there, was there any reason for Nick not to of accepted
ugh Alexa' as his child? Any reason for him to have had any grudge
against her that you know of?
Nicole: No I mean he was always proud of her. That's his first child.
ADA: No chance that he felt like that Alexa' wasn't his child?
Nicole: No I mean
ADA: Okay
Nicole: I mean he took both the children in like I mean his own. Ugh I
mean I just don't understand all this because you know I've seen a
father who doesn't want to be a father. You know my daughter
ADA: Ugh hmm
Nicole: My three year old's you know that's why I left that situation
because he couldn't care for my daughter. Ugh he was never abusive but
he just would leave her cry for long periods of time and Nick was the
total opposite of that so you know I don't understand.
***During the entire interview the
Assistant District Attorney discusses the last two days of Alexa's life
as being Saturday and Sunday. It was actually Sunday and Monday. Nicole
never corrects him.***
***He leads her several times during the interview:***

The other child jumping on Alexa'
ADA: Did he tell you that he'd actually seen ugh I don't know your
other daughters name and I apologize.
Nicole: ___________
ADA: ________ . Did he actually see ________ jump on her or did he
think ________ jumped on or
Nicole: He told me _______ had gotten scared about the T.V. Someone
that's not, she gets scared of the T.V. And she runs and she jumps on
the
couch and uhm he I don't remember him telling me that he saw her jump
on
him or on Alexa' uhm actually he said I don't know if she jumped on her
or if she just scared Alexa' so
ADA: So she started crying really loud I guess?
Nicole: But ______ acted like when I was changing her diaper ______
told me I jumped on Baby Alexa'. It was an accident and uhm
ADA: She did tell you that? Your daughter _____ told you that?
Nicole: She acted it out. She's very, she's that's her personality.
The disturbing Tylenol question
ADA: Did you give her any medicine, did they give you any medicine
other than the gas drops that you discussed?
Nicole: No I gave her Tylenol and the day before and I told the people
that I gave her Tylenol you know at the hospital and as I was leaving I
said hey you know by the way is Tylenol okay to give her or should I be
worried
about it doing damage like to her insides ugh and she said no it would
be
wise to stop because she said you're not going to do any damage to her
but
if she has a temperature we won't be able to catch it. SO
**The prosecution assumes everything in
Nicole's interview is truthful. She already had so many contradictions
in her previous statements. She was a prejudice witness who was
possibly
avoiding prosecution with the penalty of a very LARGE sentence. How
could
the prosecution believe everything she said? She takes the stand more
than
one year later and again changed her story. Why would an innocent
mother
have to lie? Why would an experienced mother ask if Tylenol would hurt
her baby's insides?**
After Nicole's interview in Exchange for immunity against
truthful statements and the investigation stops.
The prosecution has never told us why the Detective was taken
off of Dwight's case and no one was ever reassigned.
***To our knowledge, the detective was
taken off the case and no one was reassigned to continue the
investigation. No one will give us a straight answer as to why he was
removed from the case.***
Medical Information
Dr. Taylor claims injured had to have happened within last 24 hours.
Dr. Hain's report says there was a 24 hour time frame for the injury to
occur.
Dr. Gerber says Alexa's injuries occurred within one hour. Dwight's
lawyer gets him to admit that there could have been another explanation
besides the prosecution's theory.
**These time frames left equal access for
both parents to harm Alexa'. She just happened to stop breathing in
Dwight's arms. This does not prove he had to be the inflicter of
Alexa's injuries.***
Witnesses never interviewed
The police never interview Wayne, a man Nicole stayed with, she claims
she just babysat his kids, while Dwight was in Kosovo. She claims he
say these bruises on Alexa'.
The police never interview Rachela Balick, a woman Nicole claims seen
the bruises on Alexa' while she was taking her for a doctor's visit.
The police never interview the grandparents. Nicole's parents or Nick's
parents!!!
The police never interview any friends. A woman named Jody, who babysat
Nicole's other daughter, in one of her letters she claimed she took she
took her daughter out of her care because something didn't seem right.
Dwight's best friend and roommate is never interviewed. Nicole's
husband is never interviewed by police.
Co-workers are never interviewed.
January 02, 2003
the police are called on Nicole in another altercation.
POLICE REPORT #03-000105 (Incident
report was discovered after the trial)
A local Clarksville resident calls the police on Nicole the report
reads; The complainant alleged that Nicole came over to her residence
demanding to speak with her roommate. She also stated that Nicole then
began to cussing her. She asked her to leave several times before she
finally did. Warrant procedures were advised.
***Again at the trail Nicole testifies that she
is not easily angered.***
The Trial March 17-19
At the open arguments the DA paints a picture of Nick as a cold blooded
killer after they present their case and Nick's lawyer interviews his
two witnesses; officer Nalley and Nick, his closing arguments becomes a
plea for a conviction.
Nicole testifies for one day and approximately two hours. She never
looks Nick in the eye. She never sheds one real tear. As you can see by
the article the only picture they can get of a crying mother is one
with
a tissue over her face. Before she took the stand her hair was up and
she
was glowing. At the return from the break before she takes the stand
her
hair is now down and she looks a mess.
When Nick's lawyer asks her simple questions like Did you slap Art
Hambers in the face? She responds I do not understand the question. She
continues to says this every time she is caught in a lie.
All medical experts who take the stand try to diminish the time frame
for Alexa's injuries using their medical mumbo jumbo. Nick's lawyer get
them to admit, all in their own way, that there were time frames that
left
equal opportunity to for either parent to harm Alexa'. Also that the
theory
provided by the prosecution was not the only possible theory as to what
happened
to Alexa'.
***The prosecution displays a picture of Alexa'
to support Nicole's “bruising” testimony. It is one red mark on her
right leg just below her knee.***
***There were lots of pictures with Alexa' that had red marks on her
body. Sometimes in her diaper area. She clearly had sensitive skin.
These marks looked like rashes or skin irritations where she had been
touched. One picture show a red mark on the front of her leg with a
small puss like pimple in the center.
One particular picture taken one week before the one provided as
evidence shows Nick changing his daughter's diaper with his thump
holding her leg in the same spot as the red mark. Parents are creatures
of habit when it comes to changing their children's diapers. They tend
to hold their child's legs the same way every time. I never changed the
way I held my children's legs with all three.***
The trial lasts 2 days and 2 hours. What appears above was a summary of
the trial and the evidence presented. There was not one piece of
evidence that said Nick had to be the one who hurt his daughter. The
jury was sent to deliberate at approximately 10am and the verdict
returns at approximately 1pm.
Nicole's demeanor at the trial
***I have to admit I couldn't help but watch
Nicole for the entire trial. Her behavior was odd and it kept me in a
state of shock. Her and her father seemed to whisper and smirk even
through testimony by doctor's that described what Alexa' had to have
went through to suffer such horrible injuries.***
***During a break one of Nick aunts ends up on the same elevator as
Nicole and her father. Nicole makes it a point to say out loud, “I hope
he gets 52 years and the biggest mother f****r in there f**ks him up
the
a**.” Nick's aunt does not respond, but Nicole's father laughs.***
***At the break for deliberation she says to the District Attorney,
“I'll see you at the office Dan.” This to me is strange because they
should
have had a more professional relationship and she made it a point to
say
this in front of the entire family. Calling him by his first name just
seemed a bit inappropriate, especially in front of the defendant and
his family.***
The Verdict
Nick is found not guilty of Aggravated Child Abuse and Murder One, the
jury returns a verdict of guilty to lessor charges.
The Leaf Chronicle prints that Nicole was crying
the entire time from when the jury walked out and continued crying
after the verdict was read. She certainly was not. I was watching
Nicole's reaction and she didn't have one at all. She just looked at
her father with no emotional expression on her face.
She is quoted in The Leaf Chronicle as saying, “We feel that Tennessee
said it was OK to murder a 60-day-old child.”
***She doesn't realize that what they actually
said was that he did not murder his daughter at all in fact they say he
failed to protect her as defined below.***

A person commits aggravated assault who, being the parent or custodian
of a child or adult, intentionally or knowingly fails or refuses to
protect such child or adult from an aggravated assault or aggravated
child abuse.

Criminally Negligent conduct, in Dwight's case failing to protect his
child, results in death
Sentencing May 8, 2003
Sometime before the sentencing Nick's mentally ill uncle makes a trip
to Clarksville and goes to Internal Affairs. He tells them everyone
involved in the case is corrupt; the DA, the judge, and his own
attorney.
Nick is informed of this by his lawyer the day of sentencing. Nick asks
the other two family members who accompanied his uncle to stay out of
the courtroom. He was upset because he had always asked the family to
remain calm and let him handle this in the courtroom and to never ever
lash out
at the courts or Nicole.
Nicole makes a very unmoving victim impact statement to the courts.
One she claims she prepared JUST the night before. She never sheds a
tear
and looks up almost as if on cue when she says murdered or murderer but
still is unable to look Nick in the eye.
When Nick is sentenced the Judge says I didn't see any proof that you
have done this. He says there was a lot of acting in the courtroom. He
says that he does not believe Nick showed any remorse. He sentences him
to 5 ½ years to run together. Nick gets a total of 3 ½
years
with credit for previous time served. (6 months and 23 days)
***After the sentencing when Nick is being
handcuffed Nicole turns to the family waves and smirks. It was almost
an “I won” gesture.***
August 5, 2003--Our trip to the Cemetery
***Nick's mother has never had a chance to say
good-bye to her granddaughter. She has always longed to go to her final
resting place. She is buried in Maryland.***
***We made the 9 or so hour trip there to see her. When we arrived we
were told that there was a note on her file saying the owner should be
contacted if anyone requested to see Alexa'. This was strange to us.
Why
would they have to be contacted? It's not like we could just steal
Alexa's
body. Obviously someone wanted some type of warning every time someone
made an inquiry as to where Alexa' was located. ***
***We began to walk the whole 50 acres and two nice men directed us
to BABYLAND. We searched there for a few minutes and couldn't find her.
We didn't realize we had stepped over her grave several times because
she
had no headstone. There was a funeral marker about the size of an
envelope
that read ALEXA NICOLE DAVIDSON 2001-2002. This is over 1 ½
years
later. Nick's mother was falling apart so we headed back up to the
office
and asked if we could donate the head stone. They said we had to get
permission
from the owners. I chose to call Ann, Nicole's mother, and ask.
She just hung up on me.***
***When we returned home Nicole had phoned Nick's mom's house and spoke
with his step-dad. She stated she wasn't going to be bothered by
another investigation because she would have Alexa's body dug up and
cremated. Nick's step-dad was upset with us because he thought we had
told her we were still trying to reopen the case. We never had told her
mother this. Nicole took upon herself to think we were looking for
Alexa's grave just to have her
dug up for another autopsy. We never have pushed that issue. It wasn't
the
autopsy that was the problem, it was the investigation. Obviously
something
had Nicole concerned though or why would she make such a comment.***
***We contacted the Attorney General and he said that parents have
their children dug up and cremated all the time and blamed it on the
fact that the families do not get along. How many parents do you know
that have their children's bodies exhumed and cremated?***
The Parole Hearing November 18th, 2003
The Parole hearing official sets the ground
rules. There is no finger pointing this is not another trail. Nick's
family speaks before the opposition, Nicole and her father. His mother,
his little brother and myself speak on Nicks behalf. About his
character and why he should be released.
When Nicole speaks she does nothing but try to paint a terrible picture
of Nick's family. She lies about the day we went to the cemetery, she
says we went to her parents farm and screamed threats from our truck.
We haven't the slightest slue where her parents live.
***We had no way to defend ourselves we just sat
there while she lied***
She says we have started a smear campaign against
her. And that we have claimed the DA, the detective and the judge were
corrupt.
***We have never claimed anyone was corrupt, I
would say lazy and careless maybe, but never have I said corrupt.***
She also claims that our web site has put Alexa's
older sister at risk. That she had to have her removed from a daycare
b/c someone recognized her.
***We have never meant to put her
daughter, Nick's other daughter at risk, and do not know if this is
even true, but if it is we are astonished that anyone would take this
case out on an innocent child.***
She also claimed she had a slander suit in
litigation against me.
*** I have never been served papers or
been notified of a suit of any kind.***
She says she has a clear conscience. She doesn't
vomit or have nightmares.
***I think any parent would feel guilty when
their child dies.***
***First she lies about me and then tells me Nick
is lying and that my youngest son with a behavior problem & my
other children could be at risk.***
***She tries to convince me to believe her after I already know she
is lying.***
She mentions she will never have a scrapbook of
Alexa'.
***That is basically all she mentions about her
daughter***
Nicole also claims we left fake flowers with
threats written on them at the cemetery. Our flowers said, “WE WILL
FIND THE TRUTH”.
***To her this was threatening? There were two

In regards to Dwight "Nick" Davidson

The Honorable Governor Bredesen;
I have been following
several cases in the state of Tennessee that causes serious concern for
Human - Child - and Family Rights in your state as well as individual
civil and constitutional rights. These concerns are serious enough that
Tennessee is likely to share the burden of the limelight with Virginia
in my book Crimes
of State that is now being worked on in which I hope to show the inter
workings
of our human nature thru accepted scientific data that will explain how
the people in our bureaucracies can, will and do routinely violate the
rights
of the child, family and parents, the law and totally disregard the
Constitution
of the United States while fooling themselves into consistently
believing
they are doing a good and righteous work.
When you add
factors such as profiling, a need to show a processed action in a case,
and pressure from within departments as well as often from the public
to show a completed action in a case that represents closure then the
system has set itself
up for failure as well as additional crimes of its own against the
people
it was meant to serve and protect.
Everything I
have seen in the Dwight Davidson case (TDOC #00359650) screams out at
me that this is just such an incident. I have yet to see one single
incident or
concern that was a question in the mind of investigators or the court
that
was not readily explainable by anyone with even a modest amount of
experience
in such situations.
Even the code
that Mr. Davidson was convicted of violating is an often abused and
hardly
defensible one that was passed into law by many states as a CATCH ALL
to
be used when no criminal act could be showed to have taken place and/or
that it could not be ascertained as to who did in fact commit a
criminal
act in regards to minor children. As the code is written in most states
including Tennessee, it could be used to jail a parent who had lost a
child
to a drunken driver on a public thoroughfare that they walked near
while
the parent safely held the child's hands. Or even a child killed by a
lightning
strike on a fairly clear summer day. As I most often see this code
used,
it is another case of The Best of Intentions producing another BAD LAW
that
can and will often be abused.
If there is any
greater crime or sin that we as members of the Human Race and citizens
of this great country can commit beyond that of harming a child, it is
to wrongfully accuse and/or persecute and innocent parent that has
already
suffered the loss or harm of one of their offspring.
I respectfully
request that you give this case your full attention while being mindful
of
the frailties of human nature when as one with the burden to protect,
we
often with such ease and callousness take the easiest path to some/any
form
of closure.
