AFFIDAVIT
FOR PROBABLE CAUSE
STATE OF INDIANA, COUNTY OF MARION, SS
DETECTIVE LINDA KAPPES OF THE MARION COUNTY SHERIFF'S DEPARTMENT, SWEARS
AND/OR AFFIRMS THAT HE BELIEVES, AND HAS GOOD CAUSE TO BELIEVE FROM HER INVESTIGATION,
THE FOLLOWING FACTS AND ATTENDNG CIRCUMSTANCES ARE TRUE:
Marion County Sheriff's Department Deputies Rudolf Reyes and James Welch
were assigned to the Prisoner Transportation Division and on March 18, 2003
were assigned to transport prisoners from Wabash Correctional Facility and
Putnamville Correctional Facility to the Marion County Jail to appear in
various Marion County Courts. On March 18, 2003 at approximately 1600 hours,
they were transporting six prisoners from two separate correctional facilities.
The inmates being transported included Kevin Sadler, B/M DOB 4/30/81 gallery
# 516474 and David Corbin, W/M DOB 6/16/75 gallery #
459814. A court order specifically directed the Marion Cotmty Sheriff's
Department to transport inmate Kevin Sadler to the Marion County Jail to
testify as a witness in a pending case. A court order directed the Marion
County Sheriff's Department to
transport inmate David Corbin to the Marion Cotmty Jail to testify in another
case. Deputy Reyes was driving the jail wagon while Deputy Welch was
in the passenger seat.
Deputies Reyes and Welch stated that while traveling northbound on Meridian
Street just south of Maryland Street, both deputies saw the dome light flicker
in the wagon causing some alarm as to why it would be on. Deputy Welch then
looked back into the rear where the prisoners were sitting and observed inmate
David Corbin leaning on the back of his seat attempting to kick the back
passenger window out of the van. Deputy Welch observed what was happening,
causing Deputy Reyes to suddenly make an attempt to speed up the wagon to
get to the Jail to secure the inmates. Deputy Welch then observed David Corbin
break the glass Out of the window and jump out the window and run southwest
from the wagon. Deputy Reyes then immediately slammed on the brakes and stopped
the wagon in an attempt to try to catch David Corbin. Deputy Welch stated
he immediately jumped from the wagon and observed the direction of travel
of David Corbin and advised Jail Main Control of the incident that occurred
and the direction of travel. Deputy Welch stated that he yelled at David
Corbin to stop but he continued to run. By the time Deputy Reyes reached
the rear of the wagon, David Corbin was completely out of sight around a
building. Deputy Reyes then observed inmate Kevin Sadler runing from the
wagon in an attempt to flee custody. Deputy Reyes immediately tackled Kevin
Sadler in order to get him back into custody. Kevin Sadler was fighting Deputy
Reyes to keep from being handcuffed. Deputy Reyes advised Kevin Sadler to
stop resisting several times. Deputy Reyes was able to get one handcuff on
Kevin Sadler but ,was having a hard time getting the other arm behind him
so he yelled at Deputy Welch to hand him another set of handcuffs. Deputy
Welch was next to the wagon advising Kevin Sadler to also stop resisting
and sprayed him with pepper spray. Deputy Welch then handed his handcuffs
to Deputy Reyes and Kevin Sadler was then in custody. The other inmates in
the wagon stayed in the wagon and did not attempt to flee. Deputies Welch
and Reyes stated they heard several shots suddenly being fired from the direction
in which David Corbin had run.
Detective Randall Busic, who is a detective with Indianapolis Police Department,
stated he was working part time in full uniform in the downtown area walking
northbound on Meridian Street just south of Maryland Street. Detective Busic
stated he observed a white male wearing an orange jumpsuit, which appeared
to be a jail suit, running with two white males chasing him. One of the white
males chasing the subject yelled that the subject in the orange jumpsuit
had just escaped from the Sheriff's Jail wagon. Detective Busic immediately
ran across the street toward the man in the jumpsuit , when he observed that
subject now running towards him. Detective Busic stated he pulled his duty
weapon, a .40 caliber semi-automatic handgun, from the holster. and told
the white male in the jumpsuit "'to stop". The white male, later identified
as David Corbin, did stop when as ordered. Detective Busic ordered
the subject to put his hands on the rear of a vehicle that was parked in
the parking lot. Detective Busic stated he did advise control on his radio
that he needed assistance and his location. At this time, Detective Busic
ordered David Corbin to put his hands behind his back, which Corbin did.
Detective Busic proceeded to handcuff David Corbin. Detective Busic
stated he had grabbed the the handcuffs with one hand and grabbed his
radio with the other hand so he could advise he had the subject in custody.
Detective Busic stated David Corbin. handcuffed with his hands behind him
then turned to his left, reached backwards and grabbed Detective Busic's
hand gun from the holster. Detective Busic stated he dropped his
radio and
grabbed Corbin's hands as he struggled to regain control of the handgun.
Corbin fired two shots from the gun. Detective Busic stated he heard David
Corbin state to him "I'm going to kill you mother fucker." Detective Busic
stated he was trying to hold the slide of the handgun so it wouldn't fire,
however, two more shots were fired.
Detective Busic stated the other two subjects that had been running after
David Corbin, who were later identified as Eric Altamore and Edward Trainer,
began to assist him in getting control of the weapon and of David Corbin.
Eric Altamore stated he observed a white male jump from the back of a Marion
County Sherift's jail van and beginning running. Eric stated he then decided
to chase the subject who later was identified as David Corbin. Eric stated
he observed an Indianapolis Police Department officer and yelled at him that
he had just observed David Corbin jump from the back of the Jail wagon. He
then stated that David Corbin ran towards Detective Busic who had run across
the street to the eastside of Meridian Street. Eric stated the officer ordered
David Corbin to stop and was able to place handcuffs on him. Eric stated
David Corbin then began to struggle with the officer for control of the officer's
weapon when four or five shots were fired. At one point Altamore said that
the weapon was pointed in his direction as he hid behind a car. After the
shots were fired, Altamore stated he ran over to assist the officer in getting
David Corbin handcuffed.
Edward Trainer stated he also observed a white male, later identified as
Corbin, escape from the Jail wagon. He gave chase with Altamore until Detective
Busic handcuffed Corbin. At that point, he began walking toward the sidewalk
and heard two gunshots. He observed Detective Busic struggling with David
Corbin, for control of the gun. Trainer hid behind a car and saw the gun pointed
in his direction. He saw asphalt spray near him and thought a shot struck
the ground near him. After the shooting he stated he went over and assisted
with getting the handgun from David Corbin and getting him subdued.
Clayton St. John was working at the Hampton Inn. He saw two men chase a
white man in an orange jump suit though the lobby. When he followed them
to the parking lot, he saw that a police officer had the man in the orange
jump suit in custody. St. John then returned to the lobby for a few seconds
and then went back outside. He saw the officer and the man in the jump suit,
identified as Corbin, struggling for the officer's gun and shots being fired.
He heard Corbin state "I am going to kill you" or "I am going to shoot you."
St. John thought Corbin directed his comment toward one of the civilians
trying to subdue Corbin.: The civilians and the officer finally got Corbin
subdued and disarmed.
ALL OF THE ABOVE EVENTS OCCURRED IN INDIANAPOLIS, MARION COUNTY, INDIANA.

PROBABLE CAUSE AFFIDAVIT
I, Captain Clarke E. Fine who, being first duly sworn upon his/her oath or
having affirmed states:
THAT ON 7-24-95 DEPUTIES FROM THE HENDRICKS COUNTY SHERIFF'S
DEPT FOUND THAT
PERSON/S UNKNOWN HAD DAMAGED THE SECURITY GLASS IN THE INDOOR RECREATION
ROOM AT
THE JAIL LOCATED IN DANVILLE, HENDRICKS CO INDIANA. THE SECURITY GLASS WAS
SHATTERED BY FORCE, HOWEVER THE WINDOW WAS ABLE TO MAINTAIN IT'S INTEGRITY
AND NO ONE WAS ABLE TO GET OUT THROUGH THE WINDOW. DEPUTIES CHECKED AND FOUND
THAT INMATES FROM CELLBLOCK 2-E AND 2-W WERE IN THE RECREATION ROOM AT APPROXIMATELY
11OOAM WHICH IS THE TIME THE WINDOW WAS DAMAGED. THE MAIN SUSPECT WAS DEFENDANT
DAVID CORBIN AS HE IS AN EXTREME ESCAPE RISK AND HAS ATTEMPTED ESCAPE FROM
LAWFUL DETENTION BEFORE. THIS OFFICER INTERVIEWED DEFENDANT BEN GILL IN MY
OFFICE. MR GILL WAIVED HIS MIRANDA WARNINGS AND ADVISED THAT MR CORBIN WAS
INDEED THE SUBJECT WHO BROKE THE WINDOW BY KICKING AT THE GLASS. MR-GILL
NAMED ANOTHER INMATE AS ASSISTING MR CORBIN. INVESTIGATION REVEALED THAT
THE OTHER INMATE NAMED BY MR GILL WAS AWAITING A BOND REDUCTION AND WAS SUBSEQUENTLY
OR ' ED BY THE COURT TWO DAYS LATER.
THIS OFFICER THEN INTERVIEWED TWO OTHER INMATES WHO WERE
PRESENT AT THE TIME OF THE ESCAPE ATTEMPT. THE GENTLEMEN WERE INTERVIEWED
SEPARATELY. BOTH MEN ADVISE THAT MR CORBIN DID ATTEMPT TO KICK OUT THE SECURITY
GLASS AND THAT HE WAS ASSISTED BY MR GILL. MR GILL AND MR CORBIN HAD TALKED
PREVIOUSLY ABOUT ESCAPING. BOTH MEN KICKED AT THE GLASS SHATTERING IT. WHEN
THEY COULD NOT BREAK THROUGH MR GILL APPROACHED THE WEIGHT MACHINE WHICH
IS LOCATED IN THE RECREATION ROOM AND TOOK APART A BENCH IN AN ATTEMPT TO
USE THE METAL BENCH TO FORCE OPEN THE SECURITY GLASS. HOWEVER AT THAT TIME
THE JAIL OFFICERS ANNOUNCED OVER THE PUBLIC ADDRESS SYSTEM THAT RECREATION
WAS OVER AND IT WAS TIME FOR LUNCH. AFTER THE INMATES WERE TAKEN OUT OF THE
RECREATION ROOM THE DAMAGE WAS DISCOVERED. CAPT BRINKER, JAIL COMMANDER ADVISES
THAT THE COST OF REPAIRING THE SECURITY GLASS HAS BEEN ESTIMATED AT BETWEEN
ELEVEN HUNDRED AND TWO THOUSAND DOLLARS.
AT THIS TIME REQUEST WARRANTS BE ISSUED FOR THE ARRESTS
OF DAVID CORBIN AND BEN GILL FOR THE OFFENSES OF ATTEMPTED ESCAPE AS C FELONIES
AND CRIMINAL MISCHIEF AS AN A
MISDEMEANOR.
